End User License Agreement (EULA)

Please read this End User License Agreement ("Agreement") carefully before accessing or using traffiQuest ("Service"). By accessing or using the Service, you ("User") agree to be bound by this Agreement. If you do not agree to these terms, do not access or use the Service.

1. License Grant

Orion Software Development & Consulting - ADAM SZWABA ("Provider") grants User a non-exclusive, non-transferable, limited license to access and use the Service for its intended purpose. This license is granted solely to User and is subject to the terms and conditions outlined in this Agreement.

2. Restrictions

• Copy, modify, distribute, or make derivative works of the Service.
• Use the Service for any unlawful, fraudulent, or malicious activities.
• Attempt to reverse engineer, decompile, or extract source code from the Service.
• Share login credentials or otherwise allow unauthorized access to the Service.

3. Intellectual Property

The Service and all content, features, and functionalities are and remain the exclusive property of Provider. This Agreement does not grant any ownership rights to User.

4. User Data and Privacy

Provider may collect and process certain data provided by User in accordance with the Privacy Policy. User agrees to comply with all applicable data protection laws when using the Service.

5. Data Ownership and Use

Any data uploaded or entered into the Service by User ("User Data") remains the property of User. Provider is granted a license to use this data solely to operate, improve, and provide the Service. Provider will not share, distribute, or make public any User Data without User's consent, except as required by law or court order.

6. Service Access and Availability

Provider reserves the right to modify, update, or discontinue the Service, temporarily or permanently, at any time and without notice. Provider is not liable for any interruptions, downtime, or data loss resulting from service modifications or interruptions.

7. Fees and Payment

Access to certain features of the Service may require a fee. Provider will provide notice of any applicable fees prior to charging User. Failure to pay fees may result in termination or suspension of access to the Service.

8. Termination

Provider may terminate this Agreement and User’s access to the Service at any time, without notice, if User violates any terms of this Agreement. User may also terminate use of the Service at any time.

9. Limitation of Liability

Provider will not be liable for any damages, including but not limited to lost profits, data loss, or incidental damages arising from or related to the use or inability to use the Service. This limitation applies even if Provider has been advised of the possibility of such damages.

10. Governing Law

This Agreement will be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

11. Changes to Agreement

Provider reserves the right to update or modify this Agreement at any time. User’s continued use of the Service following any changes constitutes acceptance of the modified terms.
